Where such a person was subsequently tried for the offence, the indefinite notification period will cease to apply as from the end of the trial. If the person is convicted and sentenced to, say, 12 months’ imprisonment for the offence, the new notification period would be 10 years, starting from the date of the conviction. If the person is acquitted at trial, the person ceases to be subject to the notification requirements in respect of that matter.

That is why I have used my statutory powers to request data, and for the first time collected case files on child-on child sexual abuse from one police force and from one Sexual Abuse Referral Centre (SARC), where children had been referred because they had been sexually abused by another child. My office has carried out innovative analysis of the text these documents to understand more about the role that pornography might play at this sharpest end of child abuse cases. And whilst industry may have heaved a sigh of relief on completing their first OSA risk assessments this year, Ofcom is not standing still. Pornography platforms in particular are required to implement HEAA to prevent children accessing the entire site. A number of the offences in Schedule 3 are subject to age and sentence thresholds beneath which the offence will not trigger the notification requirements.
On the same day in December, Ofcom published its illegal content risk assessment guidance and its policy statement about protecting people from illegal harms online. Where there is a sufficient prospect of rehabilitation, a community order with programme requirement under part 3 of Schedule 9 of the Sentencing Code (an accredited programme for people convicted of sexual offences) can be a proper alternative to a short or moderate length custodial sentence. Alternatively, in appropriate cases, the Probation Service may be able to address the offending behaviour through a community order with a rehabilitation activity requirement. Subsections (3) to (6) replicate the partially retrospective provisions of the 1997 Act, so that, save in specified circumstances, convictions, findings and cautions that pre-date 1 September 1997 (the date of commencement of the 1997 Act) will not trigger the notification requirements.
